I have got my Labor and I-140, waiting for 485. I have completed 5 years 2 months from my 6 yrs of H1B. Can I change organization now and use Labor and I-140 as a basis for 3 years extension?

Ask your friend's friend -
1. Did he get updated employment offer before coming to USA?
2. Did his H-1B employer book his ticket or advised him to come to USA?
3. What did he specify at Port of Entry as purpose of visit?
4. Did he report for work? Is he maintaining any proof that he is working for the employer?
5. Did he ask for his salary (by email or postal letter)?
6. Does your friend know that willful misrepresentation could result in his deportation and ban on future admissions?
7. What will he do, say, for example, if his H-1B sponsor counter-sues him for cheating and fraud?

The response from the guy and the friend who is helping him to my advice is that it's no big deal. ....
Willful Misrepresentation (aka lying) is a BIG deal. Your friend's friend should seek professional legal advice and try to limit damage already caused by his actions.

I agree Pappu wearing IV gear should send a better message than wearing a Business Formal / Suit / Doctor's Uniform in a 85 F day at DC. I mean no offense to to that idea but wont that be a little funny ??
Small American Flag is a great idea but the IV gear already has a American Flag ? Otherwise may be we can stick a small Flag in the Banners and boards that we would be carrying.
Core group will have the final call about the attire though - because want to look as a unified team/group.

Here's my short experience with Wikipedia. I don't have enough data to discern a pattern yet, although based on my limited experience below, stand alone sections seem to have a better chance of surviving than inline edits.
1. I added the In-state tuition section to the H1-B visa article yesterday. That still stands as of now.
2. I tried adding ImmigrationVoice.org to the External Links section today. That was deleted as spam. Probably because it required 2 edits, although I flagged the second edit as a minor edit.
3. I've added an Advocacy Efforts section at the bottom of the page. ImmigrationVoice.org is the only link there.

Well, I also would like to reiterate that rally is a big success. But I felt that there should have been more members. I work for a company in VA and there are many people in the company, but that's only me and my colleague (that I pulled) showed up.
I met congressmen after the rally. Near the metro station (5 mins from the rally), there were 10 Indians who did not attend the rally.

One my friends told me that he had 11 H1B approvals during 1999. There are no restrictions on the number of H1B approvals one can have. I know people working part time on one H1 and full time on another.

What about all that BS that if one does not start work by Oct 1st 2007 then one could be out of status. etc.....My wife will be contiuing with her full time H1B JOB with CAP EXEPMPT employer which she has had now for 4 years..! Her H1 is already valid till march and her employer has already said that they will extend h1 too for remaining 2 years.! I mean if the consulting company refuses to co-operate with us by not sending the letter to withdraw the new H1 peitition then it really is his loss... isn't it..??...Are there any USCIS or DOL laws which state that i have a right to get copies of all these docs like LCA, 129, letter, etc...! even though i will not work for that employer.!..I mean there should be something protecting us right..!!

This is really bad; who sends the application first are the people having more wait. I know someone who filed on 2nd july and application reached on 2nd july and received by someother person there at NSC at 9.30am has received the receipt already. please any one whose application was received by B GERKENSMEYER and has recceived any update please post it here.

That should be a typo, Definitely this is the total volume of EB 485 pending at all office.
Just check the Texas Service volume trending as of July 2010 which shows less that 130k I-485 at various stages as opposed to more than 168k EB 485 pending from the inventory.:D

Hi,
My I-140 got approved from my current company. I got a good offer from another company and they are ready to start my greencard process, but being a big company, they will apply for my labor only 6 months after joining the new company. My 6 year period on H1 end in March, 2007. I am planning to get a 3 year extension from the current company and then switch to the new company may be after 2 months.
Will there be any problems with what I am planning to do?
I am not particularly concerned about porting my priority date because of the offer I got.
Please give some suggestions.

of I-94 Expiry. My atty ( Murthy ) gave me 3 options
1. Correct I-94, by taking it to Port of Entry ( I couldn't do since my passport and H1B visa and all those
documents were lost when I sent to stamping visa. I'd only I-94 since I sent a copy.... I was in fire at that time :D :D )
2. Get oout of the country and stamp visa and get in ( was not feasible for me for the same reason)
3. Do an H1B amendment, saying a slight modification in job description...
So I took the 3rd option since I'd copies of all docs.
According to my atty this is a grey area in the law. When I took everything to the Local INS office they said me, it doesn't matter the present I-94 is not valid, since I've an older H1B which is still. But please note that all those officers are not well informed. So I did not buy it. My atty told me that I could get a query in the I485 stage, but he said that I'm perfectly okay with 245(K).
After this incident I travelled out and came back in using parole. I did not have any problem. So I guess everything is okay.

Also, one more thing, did my old I-94 really did "expire" ? I mean it had an incorrect date on it (passport instead of I-797), so it shouldn't have expired, right?
I dont understand the question well. If you mean the trouble I-94 expired, Yes its expired. It is our responsibility to look and make sure everything is okay when we leave POE. If there is an error ofcourse we can appeal in the future. On most cases the decision will be favorable to us, if the mistake is genuine one. But nobody wants to get into all these hell and go for appeal, RFE reply blah blah...Send me a private mail with email so that we can be in touch. I will let you know if I get any query or any junk in the future.

That's a little unusual. I myself had passport valid till Jan 06 but my visa was stamped till June 08 and when I entered US the I 94 was valid till June 08 and not till the expiry of the passport.
Is there a rule that the I 94 is stamped till the expiry of passport/End of duration as mentioned on the visa?
Anybody with experience please respond.

My h1b expired couple of months back but did not extend it as I have an approved EAD and am continuing with the same employer who filed for my GC. I94 in my passport has the H1b expiry date. Is it safe for me to travel outside the country as I have an EAD and AP?

they are looking out for their kind....many CHC members may know families that are illegal.. you cant change their heart by flowers..it will be a waste of money..and time. (not being pessimistic here..whay do they care for legals...when they can benefit big time by supporting illegals... just think of the political milage they can gather)
like i had mentioned in my earlier posts.. the traffic on this forum has reduced..because most are happy with their EAD's....who needs a GC attitude.
we have to fend for ourselves... maybe we shoudl approach senators of indian origin...;-) ..or pro legal immi groups!

The whole point of the flowers campaign is to make the CHC realize that they can help the illegals without damaging provisions for legal immigrants right now. The illegals issue will take a LOT more thought than the issues faced by the legals. THAT is the point we are trying to drive home via the flowers campaign.
However if the IV core thinks this is a bad idea, then there is no point in doing this now.
If the flower campaign is getting old, let us do a "Fruits of our Labour" campaign on Labour Day.
On a lighter note:
Now I had suggested the IV DC Rally back in March of 2006 and it was termed by the Core/Legal counsel as a bad idea. Guess what happend after a year and half? The DC rally in Sep 2007. Let's hope the same thing doesnt happen for this flower campaign.

Hello Everyone,
I am new on this forum and was wondering if someone can shed some light on my situation. I have been waiting for a decision on my I-601 and I-212 petitions filed with the Vermont Service Center in Sept 2006. After two and a half years, on Feburary 23 at 10:30am in the morning, much to my delight I recieved two e-mails from CRIS stating that an approval notice has been sent. I check the case status on line and it stated the same thing, Approval Notice Sent. I was on cloud nice all day long.
However, the very next day I fell out of my chair when I got two more e-mails from CRIS generated on Feb 24 at 5:45am in the morning stating that denial notice has been sent for I-601 and I-212. I could not believe what I was seeing. I called USCIS customer service right away and was transfered to second level support who pretty much read off the denial notice sent message. I explained that I had recieved two approval e-mails from CRIS and the case status also showed that approval notices have been sent (luckily I made a pdf of the USCIS online status screen showing the approval). Anyhow, customer service was of no help. Now I am waiting to see what I physcially get in the mail. Nonetheless, I am so devasted and broken. Why approve the case and in less then 24 hours send a denial e-mail.
Can someone please advise?

what will happen to a spouse's EAD ( dependent 485) if the primary who has I140 approved and EB3 decides to do a EB2 and during EB2 I140 stage use EB3 I140's PD. Also once EB2 I140 is approved can primary/depedent continue to renew EAD based on ported I485 ( of EB3 to EB2 if it is possible )
Please suggest.
